This website is operated by Limitless Automation. Throughout the site, the terms “we”, “us”, and “our” refer to Limitless Automation. Limitless Automation offers this website, including all information, tools, and services available from this site to you—the user and/or customer—conditional upon your acceptance of all terms, conditions, policies, and notices stated here.

By accessing our website and/or purchasing goods or services from us, you engage in our Service and agree to be bound by the following Terms of Service (“Terms”), including any additional terms, conditions, and policies referenced herein. These Terms apply to all users of the site, including, without limitation, browsers, customers and consumers.

Please read these Terms of Service carefully before accessing our website or engaging our services. By accessing the website or engaging our services, you agree to be bound by these Terms. If you do not agree to all terms and conditions of this agreement, you may not access the website or engage our services. These terms do not exclude, restrict or modify any consumer guarantees, right or remedies under the Australian Consumer Law (ACL).

We reserve the right to update, amend, or replace any part of these Terms of Service at any time by posting updates and/or changes to our website. It is your responsibility to review this page periodically for changes.

1. Acceptance

Any quotation provided by Limitless Automation does not constitute an offer or obligation. We reserve the right to accept or decline any order for goods or services, in whole or in part, at any time prior to delivery. In such circumstances, we shall have no obligation in respect of the declined order.

2. Terms of Payment

The customer agrees to comply with all agreed payment conditions. Payment for goods and services must be made by the agreed due date, unless otherwise agreed in writing, prior to delivery or conclusion of services. Any prepayment or deposit requirements will be reasonably and clearly disclosed before purchase.

3. Limited Warranties

Our goods and services come with guarantees that are included under ACL wherein states a customer is entitled to a replacement or refund for a major defect and/or a repair if failure does not amount to major defect in accordance with the manufacturer’s warranty. Services will be provided with due care and skill and within a reasonable time.

4. Default by Customer

If the customer fails to pay any invoiced amount by the due date, we may, without prejudice to any other rights:

  • Immediately commence legal action to recover the invoiced amount, notwithstanding of whether ownership of the goods has passed to the customer;

  • Suspend or refuse to supply further goods or services to the customer;

  • Reclaim possession of any goods for which title has not passed to the customer;

  • Charge interest on overdue amounts at a rate not exceeding the standard overdraft rate offered by the Australia and New Zealand Banking Group (ANZ) at the time of calculation.

 

5. Retention of Title

Legal title in the goods shall not pass to the customer until all amounts owing by the customer to Limitless Automation, on any account whatsoever, have been paid in full.

To the extent applicable, this agreement constitutes a security agreement under the Personal Property Securities Act 2009 (Cth) (“PPSA”) and we may take all lawful steps to register and enforce our security interest.

The customer agrees to indemnify Limitless Automation for all reasonable costs, charges, and expenses incurred in recovering goods, outstanding payments, or enforcing its rights in relation to the goods, including legal and repossession costs, provided that nay such recovery or enforcement is carried out lawfully and reasonably, and does not limit or exclude any rights the customer may have under the ACL.
